Exclusivity scope
How to Define Creator Exclusivity Without Blocking Unrelated Work
Turn a broad exclusivity request into a defined list of competitors, products, channels, territory, actions, and dates that can be evaluated and priced.
Exclusivity is a map of work the creator agrees not to accept. “Category exclusivity” is not yet a usable map. Define the product, competitors, prohibited actions, channels, territory, start, end, and treatment of existing commitments before estimating opportunity cost.
Run the narrowing ladder
- All food and beverage companies.
- All non-alcoholic beverages.
- Ready-to-drink coffee beverages.
- Named competing ready-to-drink coffee products.
Each step changes how many unrelated opportunities are blocked. Start with the campaign product and move outward only when the brand can explain the conflict.
Scope matrix
| Dimension | Question | Record |
|---|---|---|
| Products | Which products create a conflict? | Narrow category definition |
| Competitors | Named list or objective definition? | List owner and update rule |
| Actions | Sponsored posts, affiliate links, production-only work, events, incidental appearances? | Prohibited actions only |
| Channels | Which creator platforms or offline appearances? | Named channels |
| Time | Does it begin at signing, production, or publication? | Exact start and end |
Audit existing commitments
Check signed projects, scheduled posts, affiliate pages, ambassador roles, unpaid editorial content, and historical posts. Disclose relevant conflicts before agreement. Decide whether old content remains accessible and whether delayed campaign launch moves the restriction.
Estimate opportunity cost
Review actual inquiry frequency and category mix rather than claiming hypothetical lost income as guaranteed. A narrow seven-day restriction may have little effect; a broad six-month restriction spanning parent companies and retailers may block normal business. Document the evidence used for the commercial decision.
Test three incoming inquiries
Apply the draft restriction to three fictional opportunities: a sponsored post for a named direct competitor, unpaid editorial coverage of an unrelated beverage, and production-only work for a retailer where the creator does not publish. If the parties cannot agree which inquiries are prohibited, the clause is not operationally clear. Record the answer rather than relying on a later interpretation.
Write a conflict log
During the restricted period, keep the inquiry date, company, product, requested action, channel, and decision. The log shows whether the restriction actually blocked work and supplies better evidence for a renewal discussion. It should not contain exaggerated forecasts or confidential details unnecessary for the record.
Source and verification note
The narrowing ladder and scope matrix are original Ratefolio tools. They help define a commercial request but do not determine whether a clause is enforceable. Broad restrictions may require professional review.
